Sony starts delivering Ice Cream Sandwich update to Xperia go, Xperia U and Xperia sola

Well, it looks like Sony's in-house software developers have decided this is the perfect week to deliver delicious treats to a large portion of the company's mobile lineup. Not long after outing updates for the Tablet S and Xperia Ion (in the US), the electronics giant is now bringing Ice Cream Sandwich to handsets such as the Xperia go, Xperia U and Xperia sola. The refresh itself brings a slew of novel traits to the trio of Xperia slabs, including a "new way to experience" music, photos and video, improvements to the lockscreen, the ability to resize widgets and the addition of a "multitasking" button. While the standout features remain the same across the board, the Xperia sola does get an added bonus in the form of a so-called, self-explanatory glove mode -- which is made possible by the device's "floating touch" technology. Sony does note that availability of the 4.0 upgrade will vary by market and, not surprisingly, carrier requirements. Let's just hope you get to enjoy the changes soon.

Another record: Kansas State University's enrollment tops 24,300

MANHATTAN -- As Kansas State University approaches its 150th year, the university reached another milestone number: a record enrollment of 24,378.

The university, which celebrates its sesquicentennial beginning Feb. 14, 2013, has the largest enrollment in its history, up nearly 500 students from a year ago. This fall's enrollment includes the largest and most diverse freshman class and more students who were first in their high school class ever to enroll at the university.

"Being the No. 1 choice for Kansas high school seniors is a special honor," said Pat Bosco, vice president for student life and dean of students. "This distinction serves our mission and demonstrates our commitment to our state. Students recognize that there has never been a better time to be a Wildcat."

Among the more than 24,000 students are more than 3,800 freshmen who have access to K-State First, a set of programs that helps integrate them into college life by connecting them with academics, professors and their fellow students.

The largest enrollment in university history includes growth on all three campuses. There are 21,179 students in Manhattan, 737 in Salina, and students are now enrolled in the Olathe campus's new graduate programs. The university has 2,445 students enrolled online. The university increased its number of on campus graduate students by more than 100.

"Growing enrollment shows that Kansas State University has the momentum to become a Top 50 public research university by 2025," said President Kirk Schulz. "Our goals for K-State 2025 include building on our strengths of providing the best undergraduate educational experience, as well as increasing the number of doctorates we award. The fact that more than 24,000 students have chosen to be part of the university family shows that they believe in the possibilities that lie ahead."

This fall's freshman class set another record for multicultural student enrollment. The campuses gained 161 more students identifying as Black, Hispanic, Asian, American Indian, Hawaiian/Pacific Islander or multiracial for a total of 3,379.

"One of the only sustainable sources of growth possible in our student enrollments yields from domestic multicultural students, and to get them here takes a proactive and concerted effort," said Myra Gordon, associate provost for diversity. "New Student Services has the strongest team for multicultural student recruitment ever, and the office of diversity Project IMPACT recruitment initiatives have exposed literally thousands of multicultural students to the K-State campus."

Gordon said student success programs like PILOTS, Diverse Success and MAPS support the retention of these students, while the climate for diversity facilitates their growth in cultural identity and cultural competence.

"Multicultural students can come here and be truly bicultural scholars and leaders," Gordon said. "This K-State rocks! That's all there is to it."

From Afghanistan to Zimbabwe to China, countries around the world are represented in the university's 2,045 international students, an increase of more than 180 from a year ago and another record for international student enrollment.

Xstrata haggles over management as Glencore deadline nears

LONDON (Reuters) - Xstrata's directors, facing a Monday deadline to deliver their verdict on Glencore's $32 billion bid, are hammering out a deal they hope will ensure the miner retains control of the combined group's board, even after the exit of its veteran boss.

All sides are working towards completing an agreement and announcing the board's recommendation by October 1, sources familiar with the deal said on Friday. However, the struggle to reconcile wide-ranging shareholder views, to ensure the success of the current, last-ditch attempt to merge, meant Xstrata's board could still ask for more time.

Glencore , the world's largest diversified commodities trader, bid in February for the shares in Xstrata it did not already own, launching one of the resources sector's biggest ever takeover deals. But it was forced earlier this month to raise its price - offering 3.05 new shares for every share held, up from 2.8 - in an effort to rescue the tie-up after opposition from the miner's number two investor, Qatar.

As a condition of the change, however, Glencore imposed its own chief executive and largest single shareholder - Ivan Glasenberg - at the helm of the combined group, at the expense of Xstrata's mining veteran boss, South African Mick Davis.

As Glasenberg was already due to sit on the board, Davis's departure within six months of concluding the deal leaves an empty spot - and one that is key to the balance of the 11-strong board. Under the original deal, Xstrata would have six board seats including the chairman, while Glencore would have five.

Sources familiar with the matter said Xstrata was not necessarily seeking a specific name, but they said the miner wanted "assurances" that a satisfactory mechanism would be set up to allow it to retain the majority of seats. Without it the deal would be a takeover and arguably require a higher premium.

"I'd be staggered if this didn't happen now," one top-50 investor in Xstrata said. "There's been unexpected give on both sides - Qatar and Glencore."

Xstrata's board is widely expected to recommend Glencore's revised, higher offer, having backed the lower offer. But its independent directors - already under fire from some minority shareholders angry that the board supported a bid many of them opposed - want to ensure the miner holds on to the team at the helm of its operations which is also expected to deliver some 20 projects by 2014, including four major greenfield sites.

The board had hoped to link a retention package for Xstrata's top employees to a vote on the deal itself thereby keeping the team responsible for its major industrial assets and the bulk of its profits.

But several top shareholders have objected, with some warning they would vote down any such package they consider excessive - and the merger in the event of a combined vote.

SPLITTING THE VOTE?

With just days to go, sources familiar with the deal said the directors could ultimately agree to separate shareholders' vote on the bid from the vote on the more emotive issue of pay.

That would allow Xstrata's board to keep the retention package it is reluctant to change - more than 140 million pounds ($226.7 million) over two years, excluding the outgoing Davis - but allow some shareholders to vote against it without imperilling the deal.

"There is a lot to balance. It is not as simple as (funds and key owners) Blackrock and L&G against the other shareholders - there are wide-ranging views," one of the sources said.

Among other funds, both BlackRock and L&G, which together own 6.5 percent of Xstrata shares, have signalled they do not support elements of the deal.

Qatar, which is not expected to make a public statement until Xstrata lays out its board's position, is said by some sources to support the retention payment and the new terms, but its ultimate position is still uncertain, leading to what several sources said was a "tense atmosphere" on all sides.

Qatar, with just over 12 percent thanks to regular share buying, has proven an unlikely kingmaker in the deal.

Hedge funds have also found themselves in the spotlight - their support could be critical, in a deal where shareholders representing just 16.5 percent of total shares could block the deal. These funds represent 10 percent of Xstrata at the moment, just enough to outweigh vocal rebels including Knight Vinke, Schroders and others.

The Xstrata board's decision, if ultimately positive, will pave the way for Glencore to file its long-awaited antitrust notification with the European Union, setting the regulatory clock ticking in Brussels, the sources said.

Glencore had been expected to file that notification by the end of September, after months of negotiations with officials to avoid a lengthy, in-depth probe. ($1=0.6176 British pounds)

US consumer spending rose 0.5 percent in August

(AP) ? Americans boosted their spending in August even though their income barely grew. Much of the spending increase went to pay higher gas prices, which may have forced consumers to cut back elsewhere.

The Commerce Department said Friday that consumer spending rose 0.5 percent in August from July. It was the biggest jump since February.

Still, the increase was driven by a 1.7 percent surge in purchases of nondurable goods. That largely reflected a sharp rise in gas prices during the month. Spending on durable goods rose 0.3 percent, helped by gains in auto sales. Spending on services rose just 0.2 percent.

Income rose just 0.1 percent in August, reflecting the weak job growth. Taking into account inflation, after-tax incomes actually fell 0.3 percent in August ? the poorest performance since November.

High unemployment and weak wage growth have kept Americans from spending more freely, which has held back growth. Consumer spending drives nearly 70 percent of economic activity.

The economy grew at an annual rate of 1.3 percent in the April-June quarter, the government reported Tuesday. That's down from the 2 percent growth rate in the January-March quarter and far too weak to lower the unemployment rate, which was 8.1 percent in August.

Earlier this month, the government released a mixed report on retail spending that showed that consumers are feeling pinched by higher gas prices.

Consumers spent 0.9 percent more at retail businesses in August from July. But excluding the impact of gas prices and a sizeable increase in auto sales, retail sales rose just 0.1 percent. The retail sales report showed Americans cut back on clothing, electronics and at general merchandise outlets.

Gas prices rose more than 50 cents per gallon in July and August, but have since leveled off.

There have been some positive signs that spending could pick up. A measure of consumer confidence jumped this month to its highest level since February. Steady gains in home prices, along with record-low mortgage rates, have helped fuel a modest recovery in the housing market.

And a report Thursday offered some hope that the job market will strengthen. Weekly applications for unemployment benefits plunged 26,000 to a seasonally adjusted 359,000. That's the lowest level in two months.

Still, most economists expect only modest hiring gains when the government releases the September employment report next week. The forecast is that employers added roughly 100,000 jobs, about the same as in August.

LONDON -- Czech-born film star Herbert Lom, best known as the deranged Chief Inspector Charles Dreyfus in the "Pink Panther" comedies, has died, according to British media. He was 95.

His agent was not immediately able to confirm the reports that Lom died peacefully in his sleep on Thursday. They did not specify where, but he had been based in London.

Born into a poor aristocratic family in Prague in 1917, he shortened his complicated name to Lom and appeared in a handful of locally made movies before emigrating to Britain before the outbreak of World War Two and making his home there.

There he built a career that spanned over 100 films and included more than its fair share of villains.

"In English eyes all foreigners are sinister," he was quoted as saying resignedly in 1991.

He portrayed Napoleon Bonaparte twice, including in "War and Peace" in 1956 alongside Henry Fonda and Audrey Hepburn, and the King of Siam in the first London production of the stage musical "The King and I" in 1953.

Two years later he collaborated with Peter Sellers in the dark comedy "The Ladykillers", and they would work together again in the 1960s and 1970s on the Pink Panther series.

In them Lom played the increasingly crazed Dreyfus alongside Sellers' hapless Inspector Clouseau, and the success of his character owed much to Lom's own improvisations.

In an interview with the Independent newspaper in 2004, Lom recalled that it was him who invented Dreyfus's nervous twitch that became his trademark gesture.

"I started winking out of nervousness, and couldn't stop," he said. "It wasn't in the script but (director) Blake Edwards loved it. But it became a problem. I made those films for 20 years, and after 10 years they ran out of good scripts.

"They used to say to me, 'Herbert, wink here, wink.' And I said, 'I'm not going to wink. You write a good scene and I won't have to wink.'"

Wills vs. Trusts Revisited

For too long now, I've been living up to name and procrastinating in estate planning. With our first child on the way any day now, it is time to make sure that all the "t"s are crossed and the "i"s are dotted. That's why about a month ago, I asked readers do you have a will or a trust?

I had been reading the book Living Trusts for Everyone: Why a Will is Not the Way to Avoid Probate, Protect Heirs, and Settle Estates, which makes a strong argument for a trust. It does a great job of putting the fear of probate into you as if it is the financial boogeyman that should keep you up at night. Maybe it actually is with your assets being tied up for months and the legal fees around it.

With that in mind, I went to see Janet Brewer an estate planning attorney in Palo Alto. She was kind of enough to offer a free hour consultation. What I found out was that we probably don't need a trust. I was concerned about our real estate in multiple states. It appears that if my wife and I put them in a joint tenancy we can avoid probate. If I die first she'll just get 100% of the assets and vice versa for me. We avoid probate unless we both die at the same time, which is statistically rare. In looking at our other financial assets (brokerage accounts, 401Ks, Roth IRAs, etc.) as long as we designate each other as beneficiaries it avoids the evil probate monster. Although when one of us dies, the other would be wise to get that trust set up.

So why not set up a trust now and just be done with it? Well, there are a couple of reasons. One is cost. Trusts are generally more expensive to set up. The bigger one for us is that we tend to move around a bit. We don't plan to be in California forever and setting up a trust here would require a major reworking if we were to move back to New England as we hope. (In case you didn't know, California tends to do a few things "differently" than the rest of the nation, and trusts are an example of that.) One thing she did mention is that we might be wise to set up a corporation for the properties. That's something that I've looked briefly for Lazy Man and Money, but not the real estate. I'll have to put looking into that on the to-do list.

At the end of the meeting with Janet Brewer, we all mutually agreed that her services weren't exactly in our best interest, and we walked away without giving her any business. I love when people turn away business when it isn't in the best interest of their clients. It gives me confidence that if there are others in Silicon Valley looking for estate planning services, her office would be a great place to start.

ABOUT THE PRODUCTION

Josh Foldy, making his Triad Stage directorial debut, directs The Woman in Black. Foldy was most recently seen on stage in A Christmas Carol and Dial ?M? for Murder at Triad Stage and in Billy Bishop Goes to War in The UpStage Cabaret. Foldy is also a member of the performance faculty at UNCG. Jeffery West, a Triad Stage veteran (New Music, Part II: Better Days, Providence Gap, Ghosts) portrays Arthur Kipps and Matthew Delaney (New Music, Part I: August Snow and Night Dance, A Christmas Carol, Providence Gap) portrays the actor hired by Kipps. Ella Moore also makes her Triad Stage debut.

The creative team includes scenic designer Matthew Emerson, costume designer Andrew Landon Cutler, lighting designer Perry Ransbottom and sound designer Jonathan Fredette. The stage manager is Amy E. Jonas. ?

Report: Iran commander warns of 'World War III'

Updated at 4:46 a.m. ET: Iran could launch a pre-emptive strike on Israel if it was sure the Jewish state were preparing to attack it, a senior commander of its elite Revolutionary Guards was quoted as saying on Sunday.

Amir Ali Hajizadeh, a brigadier general in the Islamic Revolutionary Guard Corps, made the comments to Iran's state-run Arabic language Al-Alam television, according to a report on the network's website.

"Iran will not start any war but it could launch a pre-emptive attack if it was sure that the enemies are putting the final touches to attack it," Al-Alam said, paraphrasing the military commander.

Hajizadeh, who heads the Guard's aerospace division,?said any attack on Iranian soil could trigger "World War III."

"We cannot imagine the Zionist regime starting a war without America's support. Therefore, in case of a war, we will get into a war with both of them and we will certainly get into a conflict with American bases," he said.?"In that case, unpredictable and unmanageable things would happen and it could turn into a World War III."

At schools, in shops, and on the streets of big cities and small towns, daily life plays out in Iran.

'Bases are equal to U.S. soil'
U.S. facilities in Bahrain, Qatar and Afghanistan would be targeted, he added.?

"There will be no neutral country in the region," Hajizadeh was quoted as saying.?"To us, these bases are equal to U.S. soil."

Iran readies domestic Internet, blocks Google

The U.S. Fifth fleet is based in Bahrain and the U.S. has a heavy military presence in Afghanistan.

U.S. officials reportedly suspect Iran is behind a string of recent cyber attacks that were aimed at major U.S. banks. Jim Finkle of Reuters has more on the story.

The Iranian warning appears an attempt to reinforce the potential wider consequences of an attack by Israel. The message is not only intended for Washington, but to its Gulf Arab allies that are fearful of a regional conflict that could disrupt oil shipment and cripple business hubs in places such as Dubai and Qatar's capital Doha.

It also comes during a major show of naval power in the Gulf by U.S.-led forces taking part in military exercises, including mine-sweeping drills. The U.S. Navy claims the maneuvers are not directly aimed at Iran, but the West and its regional allies have made clear they would react against attempts by Tehran to carry out threats to try to close critical Gulf oil shipping lanes in retaliation for tighter sanctions.

Friction mounts as Israel asks that U.S. give Iran an ultimatum; a tricky position for Obama, whose foreign policy has been lauded. NBC's Andrea Mitchell and CNBC's John Harwood report.

Despite Israeli hints of a military strike, Iran's military commanders believe Israel is unlikely to take unilateral action against Iran. The Guard's top commander, Gen. Mohammad Ali Jafari, said last week that Iran believes the United States won't attack Iran because its military bases in the Middle East are within the range of Iran's missiles.

Iran denies hacking into US banks

Iran has also warned that oil shipments through the strategic Strait of Hormuz will be in jeopardy if a war breaks out between Iran and the United States. Iranian officials have previously threatened to close the waterway, the route for a fifth of the world's oil, if there is war.

Israeli Prime Minister Benjamin Netanyahu discusses the "danger of not acting" in the era of a potentially nuclear-armed Iran.

Israel believes that any attack on Iran would likely unleash retaliation in the form of Iranian missiles as well as rocket attacks by Iranian proxies Hezbollah and Hamas on its northern and southern borders.

Prime Minister Benjamin Netanyahu has made increasing hints that Israel could strike Iran's nuclear sites and has criticized President Barack Obama's position that sanctions and diplomacy should be given more time to stop Iran getting the atomic bomb.

U.S. Ambassador to the United Nations Susan Rice explains the extent of Iran's nuclear capabilities, including the U.S. plan for response to such an incident.

Tehran denied it is seeking weapons capability and says its atomic work is peaceful, aimed at generating electricity.

Iran's President Mahmoud Ahmadinejad is currently in New York to attend the annual U.N. General Assembly and could seek to use his speech and meetings later this week to highlight the possible risks ? including sharply higher oil prices ? if military action is taken.

Ohio U. marching band takes on 'Gangnam Style'

The return of fall and football are welcome distractions for a nation consumed by "Gangnam Style." But the Ohio University Marching 110 ignored our desire to get back to hearing "Call Me Maybe" everywhere and unleashed a version of Korean singer Psy's catchy dance track.

While most big bands are still trying to learn their way around "Thriller" for halftime entertainment, these guys and gals do a pretty great job of combining their instrumental skills with some not-bad-for-the-band dance moves.

Plenty of wanna-be Psys are out there attempting that gallop dance in the privacy of the entire Internet, so kudos to the band for doing it in front of a packed stadium. We love the pause and applause at the 2:00 mark before it rips back into the distinctive drum beat of a marching band. What's more American than a crisp, autumn day at a football stadium in Athens, Ohio, as Korean pop music washes over the crowd??

Complete with gyrating cymbal players at the 50-yard line, the Marching 110 -- founded in 1923! -- should feel no shame in extending the shelf life of "Gangnam Style" just a few more clicks (791,000 and counting on YouTube).

Don't know why but it's so much fun shopping in the Tawas/Oscoda parts. ?We spend our money in little shops, in small farmers' markets, and at family restaurants.

When at all possible, we have lunch at The Old Place Inn in Harrisville. ?Don is a brainiac when it comes to soup and we drive north with breathless anticipation each Saturday.?This weekend, the soups were butternut squash, beef barley, senate bean, and (creamy) chicken with dumplings.

There is no picture of the butternut squash; ?I got the second to last serving and I wasted no time on that cup. ? All his soups are homemade and out of this world.

and yes, I was taking pictures of the soup while eating. The couple next to us thought it was a hoot.

Our trip to the farmer's market (in East Tawas) was fruitful despite the rain. I have fabulous looking (and tasting) radishes and some enormous green onions.


We grabbed some steaks at Klenows (best meat place in the state) to throw on the grill. ?Along with a great bottle of wine from Brew Krew, dinner was a home run.

All that's left is for the Tigers to catch the White Sox. Go Tigers!

Redbox app for Android update brings a new UI and better filtering, no Instant streaming yet

The official Redbox app for Android hasn't seen many changes since it was first introduced early last year, but that's changing with version 3.0. Now available in Google Play, it brings a new look that should make browsing a bit easier, plus enhanced filtering (you can sort Blu-ray discs by genre) and the ability to sort by date or alphabetical order. Finally, support for push notifications could mean unsubscribing to those weekly texts for coupon codes, and users report you can now input the coupon codes in the app while making reservations. We poked around but couldn't find any references to its Instant streaming service, so there's at least one thing to expect for the next update. Android powered kiosk renters can grab the app at the source link below.

Saltus River Grill to hold Leukemia & Lymphoma ... - Cancer Kick

BEAUFORT, SC (WTOC) -

Saltus River Grill, located at 802 Bay St. in Beaufort, will be hosting a benefit for the Leukemia Lymphoma Society from 5 p.m. to close Sept. 27. A portion of the event?s proceeds will be donated directly to cancer research.

Will Messmer and Kelly Hartman, two of Beaufort?s Team in Training members, are leading the charge for the benefit event. The benefit is one of the multiple efforts by the members to reach their combined goal of $6,000.

?We are happy to help our patrons in any way we can,? said Saltus River Grill Owner Lantz Price in a press release. ?This is an important cause, and one particularly important to me, as my father is a Lymphoma survivor. I believe it?s definitely possible for us to help make a positive impact.?

Found: Gene that gave tabby its stripes

From where does a tabby cat get its stripes? The same place cheetahs get their spots.

A new study finds the same gene that is responsible for the cheetah's color patterns causes a tabby's stripes. Mutations in this newly identified gene transform a tabby's typical striped pattern into a less familiar "blotched" look. In cheetahs, similar mutations smear spots into thick stripes.

"What this is, is the first connection of a gene involved in pattern formation in cats to their molecular status," said study researcher Stephen O'Brien of the National Laboratory for Cancer Research.

Now "we know where the mutation is in this particular gene" to cause the pattern changes, O'Brien told LiveScience.

Stripes or spots?
O'Brien and his colleagues contributed to the original sequencing of the domestic cat genome, which was completed in 2007. Besides being interesting from a basic science standpoint, O'Brien said, cat genetics may help researchers understand human disease and genetic development. [ The 10 Coolest Genomes Ever Sequenced ]

One mystery of cat development is how cats have come to have such varied coats, from solid colors to "mackerel" tabby patterns of thin vertical stripes. The researchers were particularly interested in what turns the mackerel pattern into a "blotched" tabby pattern, seen more often in European cats than American ones.

A map of kitty pedigrees allowed the researchers to narrow down the genetic culprit to one region of the chromosome containing three large genes.

They then sequenced the genomes of two batches of tabbies, one with blotched coats and the other striped ones, and narrowed the culprit further to a gene called Taqpep.

Three separate mutations of the Taqpep gene in the domestic cat and another mutation in the same gene in the king cheetah can cause the tabby pattern to go from striped to splotchy, and, in the cheetah, from spotty to striped, the researchers found.

This means the gene has mutated multiple times across kitties' evolutionary history.

Cat color blueprint
The Taqpep gene holds the blueprint for a molecule usually found on cell membranes and used for passing messages from outside the cell to the inside. A mutation of the gene causes color pattern changes by interfering with the deposition of pigment during development, O'Brien said.

O'Brien suspects the gene also has other functions. Membrane-communication molecules are often associated with the immune system, he said. The fact that this coat-color mutation occurred many times suggests that it may be doing something more useful for the cats than simply changing their spots and stripes. One possibility is that the genetic change influences immune function, he said, and that the coat color variations seen in cats are a side effect of that change.?

"I think that probably there are other things to be discovered about this gene," O'Brien said.

What happens to a consumer's credit report when

The Credit Repair Organizations Act (CROA) requires that consumers not be misled about how their credit reports might be affected by a company?s actions on their behalf.? This law was intended to apply to companies that promise to ?repair? a consumer?s credit history for a fee.? Non-profit credit counseling companies are specifically exempted by the language of the law itself.? However, in a ruling by the?1st Circuit Court, credit counseling companies must prove that they are operating in an appropriate manner or be subject to the provisions of the CROA statute.

This obviously creates a dilemma for credit counselors who are asked by consumers what impact entering a Debt Management Plan (DMP) might have on their credit reports.? There is no attempt by the credit counseling organization to ?repair? the consumer?s credit history yet, the 1st Circuit ruling introduces caution in responding to this question.? On the other hand, consumers should be aware of the process.

When a creditor reports to a credit bureau that one of their customers has entered a DMP, the bureau codes the consumer?s credit report accordingly.? There is no impact on the consumer?s credit score strictly from the act of joining a DMP.? However, it may well be that the consumer?s credit behavior that led to them needing DMP assistance could have impacted the score anyway.

Creditors generally do not view the fact that a consumer is on a DMP as negative.? Rather it is usually seen as an attempt to honor their obligations and is certainly seen as more positive than personal bankruptcy.? Further, the education that is received as part of a DMP, along with the counseling, is intended to rehabilitate and produce a more credit-worthy consumer in the future.? Creditors may also see this as positive.
